  1. What personal data we collect about you and where we get it from?

Generally

We collect most of the data directly from you when you order from our website. We get technical details from the devices you use to access our website and from cookies which tell us what you look at online, where and when. Like most other websites, our technology also lets us know when and how you use our websites, such as when you have added to or abandoned your basket or filled in a form.

The personal data we collect and use will depend on why we need it. We will only collect the personal data which we believe that we need to use, which is needed to be collected by the applicable law or which you have agreed we can collect from you or agreed someone else can share with us.

Sometimes we are given data about you unexpectedly, such as from the police, organisations and agencies trying to prevent threats and fraud, and from the public.

Guest Customers

You may order from our website without signing up for a membership and proceed to checkout as a guest. In such case we collect your following data;

  • ID number, tax number, personal company information (if you conduct the purchase via a company)
  • If you make your payment with your credit card, your credit card information (which will be transferred to the relevant payment institution without being registered with us)
  • The shipping form that you fill for the delivery of your order.

Registered Users

  • Identity information (name, date of birth)
  • Your contact information (address, phone number, e-mail address)
  • Gender information (optional)
  • Monitoring your actions whilst usage of the Site.

Order Information (order date, time, quantity, order content, payment method, etc.) is automatically logged in to our system as a part of monitoring your actions.

  1. What we do with your personal data?

Generally

We need to collect and use lots of data about you so that you can use our website, order products from us and learn about our offers and new arrivals. We also need to use some details to prevent and detect fraud.

We look at and learn from your browsing, shopping and how you respond to our marketing to understand what sort of customer you are and predict what products we have that you may also be interested in. We try to show you adverts and offers we think you will like tailored to you based on stuff like your location, including what we know about you including through website and other websites you visit, relying on the extra understanding about you which ad providers and social media platforms have collected with your consent.

If you do shopping as a guest customer or registered user, we are processing data in order to;

  • carry out after-sales operational processes such as repair, exchange, return, cancellation, inspection, etc. (identity, contact details and shopping information)
  • get in touch with you, as and when found necessary, at times such as; when there is incomplete orders, when there is filled but not finalized baskets, not realizing a purchase after registering as a member
  • deliver your order to you (your identity and contact information)
  • distinguish your records from our other customer’s records (your identity and contact information)
  • issue invoices (your identity and billing information),

If you become a registered user we are processing data in order to,

  • fulfill the requirements of your membership agreement (identity and contact information),
  • enable you to make your purchases directly through your membership without being have to re-enter your personal details each time you order from our website (your identity, contact information),
  • enable you to view the details of your current and/or previous orders and its/their relative invoices (your identity, contact and order details),
  • to create/conduct public or personalized campaigns, benefits, promotions, advertisements, marketing activities (information about your details of use of the website.

 

3.Who we share your personal data with and why?

We share your data only as described below and also with our subsidiaries following practices at least as protective as those described in this Privacy Policy.

  • Third Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders for products or services, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content and providing customer service. These third-party service providers have access to personal data needed to perform their functions, but may not use it for other purposes. Further, they must process the personal data in accordance with this Privacy Policy and as permitted by applicable data protection laws.
  • Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise).
  • In addition, we may disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, and (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.
  • Other than as set out above, you will receive notice when personal data about you might be shared with third parties and you will have an opportunity to choose not to share the data.

 

4.Where we send your personal data outside Europe?

Business for us and many suppliers is international so your personal data may, at times, be handled in a location outside Europe. When this occurs, we take care in ensuring the security of your data. In the event you ask us to deliver your order outside of Europe, we need to send limited details outside of Europe to fulfil this request.

Due to the location of our server and/or depending on where we store all or part of our data, we may transfer your data to appropriate safeguards within the context of applicable law. 

5.How do we keep your personal data secure

We maintain administrative, technical and physical safeguards to protect your personal data against accidential, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

For leaks due to hazards, security threats, malware, cyber-attacks including without limitation hacks, unstoppable virus spreads, system or infrastructure breakdown, we shall not be liable.

We will keep your personal data during the period that you are a customer with us and then for as long as is necessary in connection with both our and your legal rights and obligations. This may mean that we keep some types of personal data for longer than others.

These include rights to access and correct your details, in some cases, to ask us to limit or stop our use of them and even to delete them.  Where we use your personal data based on your consent, you have the right to change your mind and you can always unsubscribe from our direct marketing to you, by simply clicking unsubscribe in a marketing email, or in this policy. 

You may apply to Tohum Design about your personal data which is processed by Tohum Design AND;

  1. a) learn whether your personal data is processed,
  2. b) request information about the processing of your personal data,
  3. c) learn the purposes of processing your personal data and whether they are used in accordance with their purpose,
  4. d) learn your personal data if it has been transferred to third parties in Europe or abroad,
  5. e) request your personal data to be corrected if it is incomplete or incorrectly processed,
  6. f) request the deletion or destruction of your personal data if the reason of processing is not legally required,
  7. g) request the third parties; whom your personal data is transmitted to; to be notified of your requests specified in paragraphs (d) and (e) and to perform the same transactions,
  8. h) object to the adverse consequences of the analysis of your personal data through automated systems,
  9. i) have the right to claim compensation for any damage caused by illegal processing of your personal data.
